Employment law

Sooner or later, everyone comes into contact with employment law. Whether it’s a first part-time job whilst at school, vocational training, an employment relationship, or setting up, taking over or continuing a business – there are always specific aspects of employment law to bear in mind.

Our expertise in employment law

Legislation and case law relating to employment law, particularly at European level, are becoming increasingly refined. As Germany still lacks a unified labour code, it is particularly important to keep abreast of the latest case law. Changes in (socio-)political circumstances are implemented particularly swiftly in employment law.

Through ongoing specialisation, employment law has become one of our firm’s core areas of expertise over the last 20 years. We now have three specialist solicitors who provide expert and practical advice to both employers and employees. Thanks to our extensive experience in works constitution law and staff representation law, we also represent many employers, works councils, staff councils, and youth and trainee representatives in this area.

Within the field of employment law, we are happy to assist you with the following matters. However, you are also welcome to contact us regarding any other areas of employment law.

Drafting of employment and service contracts

Entering into an employment contract lays the foundations for the entire employment relationship. We can assist you in drawing up a contract that complies with the law – from remuneration and annual leave through to overtime arrangements, and covering matters such as place of work, company cars and non-competition clauses.

The implementation and termination of employment and service contracts

When is an employer permitted to unilaterally change working conditions? What needs to be taken into account in the event of transfers or termination with the offer of alternative employment? We can advise you on the requirements and formalities for a valid termination, on the applicability of collective agreements or works agreements, and on topics such as the minimum wage, record-keeping obligations and termination by mutual consent – including any potential implications for unemployment benefit.

Works Council Law

What does a works council do? How is it elected? What does the existence of a works council mean for a company? What does the principle of ‘cooperation based on trust’ entail? When and how must the works council be involved? What happens if it objects? When must the conciliation committee or the employment tribunal be involved? How is a works agreement negotiated, or a reconciliation of interests and a social plan finalised?

Staff representation law

When and how should the staff council be elected, and how should it be involved in the employer’s decisions and measures? Can the staff council influence or prevent measures taken by the employer?

Lectures/Seminars/Training courses

We share our knowledge and experience in all areas of employment law through in-house training sessions at your company or organisation, or in the seminar rooms at our law firm.
